These are the terms and conditions applying to all contracts or engagements (a “Booking” or “Bookings”) made between:-
1. Simulator Bar Limited (a Company registered in England with number 15081507 having its registered office at 8 Levens Close, Poulton-le-Fylde FY6 8NJ) (“We”, Us” or “Our”); and
2. The Customer (“You” or “Your”)
In these terms and conditions “The Customer” means the person making a Booking with Us.
The following conditions apply to You in respect of all such Bookings.
By proceeding to pay for the Booking You have accepted that these terms and conditions apply to that Booking.
1. Amendments: Bookings can be amended free of charge up to 48 hours before Your appointment. Any desired changes within 48 hours of Your Booking shall (at Our discretion) incur additional charges or be declined.
2. Cancellations: Bookings can be cancelled only in exceptional circumstances. We will only accept cancellations made more than 48 hours before the scheduled appointment. Failure to cancel within this timeframe shall result in forfeiture of any fee or charge paid when the Booking was made.
3. Responsibility for Bay and Equipment: You are solely responsible for the condition of the bay and any equipment provided by Us for Your use during the visit by You and Your visitors. Any damage to or loss of equipment must be reported immediately and shall, at Our discretion result in You paying Us all charges We incur in remedying such damage or loss.
4. Standard of behaviour: You are solely responsible for the cost or repairing or replacing any damage caused as a result of inappropriate behaviour, including but not limited to misuse of equipment. Your responsibility in this respect extends to and includes damage whether caused by negligence or intentional actions.
5. Liability: We reserve the right to refuse service to or remove individuals from the premises in the event of disruptive behaviour or failure to comply with any of Our rules and regulations governing Our business operation.
6. Amendment: We reserve the right to amend these terms and conditions at any time without prior notice. Any amendment shall be reasonable and as We consider required for the better operation of Our business and the comfort and security of You and Your visitors. Any such amendment made after Your Booking shall apply to Your Booking.
7. Health and Safety: By making your Booking You acknowledge that there are inherent risks associated with permitted activities related to Your Booking as a result of the same taking place in a confined space. While We have taken what We consider to be appropriate precautions to ensure a safe environment, injuries can still occur. You accept that You and Your guests or visitors participate at Your and their own risk. By engaging in activities at our venue, each player is deemed to accept these risks and assume personal responsibility. Simulator Bar Limited, its owners, employees, and affiliates shall not be held liable for any injuries, damages, or losses incurred during golf activities, including bodily harm, property damage, or other forms of loss.
8. You, Your guests and visitors must exercise caution, adhere to safety guidelines, and use equipment correctly. By entering Our venue and participating in, all participants, guests and visitors shall follow all safety instructions provided by facility staff and shall be responsible for their own safety while in Our venue.
9. These conditions clarify the understanding between Us and You related to Your Booking. You accept that these conditions stress individual accountability and risk awareness in recreational activities. You must ensure that Your guests and visitors invited by You or forming part of Your group are aware of their responsibility and that they understand and accept these terms and conditions by attending Our venue.
10. Alcohol: Our venue is a licensed premises. We reserve the right to refuse service to individuals or groups and may at Our discretion require you or Your guests and visitors to provide age verification before consuming any alcoholic beverage.
11. Drugs: No drugs may be consumed at Our venue. We shall report any suspicious conduct to the Police.
Simulator Bar Limited Membership Terms and Conditions:
1. Membership is non-transferable and solely reserved for the individual named on the membership agreement. Sharing membership privileges or transferring membership to another individual is strictly prohibited.
2. Members are required to attend all bookings made under their membership. Failure to attend without prior cancellation may result in penalties, including the forfeiture of booking privileges.
3. Repeated instances of no-shows, defined as failing to attend booked sessions without canceling in advance, may lead to the withdrawal of membership privileges at the discretion of Simulator Bar Limited management.
4. Members are responsible for ensuring that their guests adhere to all facility rules and regulations. Members must accompany their guests at all times during their visit to Simulator Bar Limited.
5. Any breach of these terms and conditions, including but not limited to misuse of membership privileges or disruptive behavior, may result in the suspension or termination of membership without refund.
6. Membership fees are non-refundable and subject to change at the discretion of Simulator Bar Limited management.
7. Members are required to notify Simulator Bar Limited of any changes to their contact information or membership status.
8. Simulator Bar Limited reserves the right to amend these terms and conditions at any time and will notify members of any changes via email or written notice.
9. Memberships will automatically renew each month unless cancelled by the member. Members are responsible for managing their membership status. Failure to cancel membership renewal will result in the continuation of monthly membership fees.
Simulator Bar Limited Range Night Offer Terms and Conditions.
1. Range night prices (£10) gives you limited access to the simulators. Limited access comes in the form of being able to use the facility for practice on the virtual driving (FSX Play/Pro), putting and chipping greens.
2. The price is aimed at competing with driving range prices therefore full access of the simulators software requires a top up of £20 per hour.
3. Booking multiple hours at the reduced price does not affect the use of the simulators, multi hour bookings are expected to stay on the allowed functions granting a longer practice session.
